Fleur Pellerin challenges the legality of playing unlimited subscription service of the US giant.
As was to be expected, response to the launch of its offering by Amazon Kindle Unlimited was quick. Ten days after the marketing of the subscription service – which allows for 9.99 euros per month to access a library of 700,000 shares (of which 20,000 in French) via the Kindle reading light – the letters from people Society (LDMS) reacted strongly Monday, declaring himself “resolutely opposed” to the service. The same day, the Minister of Culture, Fleur Pellerin, grabbed the new mediator of the book for legal advice.
This subscription service, Amazon is not the only operator to offer in France “does not seem consistent with the law”, said the minister, who was following the case for several weeks and had sought the assistance of the Directorate General of Media and Cultural Industries (DGMIC) and that of the Centre . National Book (CNL), under his tutelage, to address the topic
“Our position is simple: all these new offerings must comply with the 2011 Act, that is, -dire respect the principle of fair compensation for all industry players, including authors, “said a spokesman for the ministry, adding that the law states that it is for the publisher to fix the price of the book, whether printed or digital.
It’s Laurence Engel, Aurélie Filippetti former Chief of Staff at the Ministry of Culture named to the newly created position of mediator book Last September, so that bears the burden of bringing together publishers and relevant distribution platforms early January to make it “as soon as possible its opinion on the articulation of subscription offerings with the framework set by the law, “reported the Rue de Valois.
The question of legality in France for this type of subscription unlimited supply has been asked by the president of CNL, Vincent Monad, as well as the LDMS, which represents 6,000 authors. It is even the first time the author objects to an Amazon initiative. In particular, they point out that, as has been found in the music, this type of device is extremely low wage for artists. “Now we do not know today the conditions publishers compensation in the service offered by Amazon, much less those of the authors,” says the LDMS.
In the case of a subscription a public library, for example, a law of 2003 specifies that the author may object to the lending of copies of his book but it entitles him to compensation, part of which, at the expense of the state, is sitting on a flat-rate contribution per user, and another, paid by booksellers, corresponding to 6% of the price of the book sales excluding tax books sold to municipal and university libraries.
But it is not certain that such a system in the public service or applicable to private platforms. In any event, with a few exceptions, all the major French publishing houses have still not signed an agreement with Amazon to integrate the catalog of Kindle Unlimited.
